A public meeting will be held by the Humboldt County Board Of Supervisors to consider renewal of a building permit to allow construction of a 4,000 square foot building and 65 stall paved parking lot, within the public's Lynn Vietor Nature Preserve. The 14.31 acre Nature Preserve is located on Indianola Road, east of Highway 101, at the northern boundary of Eureka.

The meeting will be held at the Humboldt County Board Of Supervisors' meeting room, County Courthouse, 825 Fifth Street, Eureka, CA 95501; (707) 445-7256, on March 27, 2001, at 1:30 p.m. The public is invited to attend this meeting.

The organization "Save The Public's Lynn Vietor Nature Preserve";
seeks to prevent any further construction within the Nature Preserve, so that members of the public can enjoy it as the founder intended, in its "native and unspoiled" condition.

At the 27 March 2001 Supervisors hearing, HAF's building permit extension from an original 1998 application was approved. The Supervisors staff report essentially said that nothing has changed from the 1998 application, i.e. as to sewage, traffic, zoning, etc.--the application is just an extension of the 1998 approval (which no one with Vera's interests knew about or were represented). Vera's watchdogs pleas (and those of nearby neigbors) that the 1998 application was bogus (even fraudulent) in that HAF essentially did not divulge that they were not but only masquerading as the OWNERS of the property. HAF did not divulge that they were in fact the interloper (1994) `land trustees' with a solemn fiduciary responsibility to protect the public's Lynn Vietor Nature Preserve, were instead duplicitiously DESTROYING it. I.e it was a case of abusive land use (misuse), and Santa Claus (grant making) HAF should repect (and as trustees guard) the public nature preserve and move offiste to expand, rather than play the `destructive monster' trustees and destroy gifts to the public, which Vera had entrusted to her trustees (Crocker, cum Well Fargo, now interloper HAF).

Subject: Duplicitous Building Permit For HAF To Destroy Public Nature Preserve

Humboldt County Supervisors

This is an official written protest to the Humboldt County Planning Commission's two year renewal of HAF's 1998 permit to build offices, paved parking within, and do irreparable damage to, the North Coast public's Lynn Vietor Nature Preserve at Indianola. This is as passed at the Planning meeting, the evening of 18 January 2001, with we the HAF founder Vera Perrott Vietor's objections as `interested and affected' parties to the destruction of the public's Nature Preserve being ignored.

This is a slightly revised copy of our original protest letter of 25 January 2001, addressed to the Humboldt County Supervisor at the Planning Commission address on H street. This updated copy is addressed to the Humboldt County Court House address, as prescribed in the `Public Hearing' notice of 1 March 2001.

HAF Founder Vera Perrott Vietor in her 1972 will first and foremost created the public's Lynn Vietor Nature Preserve of her property, to be guarded `native and unspoiled' as a Nature Preserve. She also mandated that HAF was to have the income only (eggs) off the San Francisco Bank Principal Trust (hens). HAF have violated the `letter and spirit' of our aunt Vera's will. HAF has failed to uphold their serious and solemn fiduciary responsibility to husband and guard the public's Nature Preserve. Instead HAF have illegally used invaded trust principal funds to `maintain' (an euphemism for destroy) the property, the Nature Preserve and architecturally significant Portland architect John Yeon designed and landscaped Vietor residence in 1995 and planned further destruction (announced June 1999). This architectural masterpiece was of a quality to be displayed in the New York Museum of Modern Art alongside works of Frank Lloyd Wright in the early 1940's. See Portland architect W. J Hawkins III's `to whom it may concern' in our 16 Jan 01 submissions to Planning. `Break ground' on the project planned for August 1999 has been stalemated for the past 20 months due to legal and other objections over the illegality of the project.

In reviewing the files at Planning, it is clearly documented that HAF in 1994 approached Planning to get a permit to cut trees, pave, and despoil the architecturally significant Vietor residence (without divulging their plans to the Court). HAF in their applications did not divulge that they were proposing to destroy the public's Lynn Vietor Nature Preserve, not as OWNERS, but as TRUSTEES with a fiduciary responsibility to protect it for the real owners, the North Coast public. Planning (presumably unknowingly) issued the 1994 building permit. We as interested and affected parties knew nothing of this clandestine 1994 (permit) and 1995 (construction) activity. In 1998, HAF got Court permission to carry out their second act of destruction (Vera's interests were not informed or represented in court). HAF admitted well after the fact (1998 court filing) that HAF had used Vera's embargoed trust principal in the previous 1995 construction (1994 planning request). In both instances without HAF founder Vera's `interested and affected' parties being legally informed.

We recently reviewed the 1994 and 1998 application files at Planning, approximately 1" and 3" thick respectively. Nowhere in those voluminous application files to the authorities do HAF divulge that they do not OWN the land. That rather HAF are only the TRUSTEES with the solemn fiduciary responsibility to husband and guard the public's Lynn Vietor Nature Preserve `native and unspoiled' for posterity (See tax assessors parcel description attached hereto). HAF do divulge in great detail their intent to destroy and pave over the Nature Preserve.

Our legal advice is that Planning may have been duped by HAF in HAF's misleading 1994 and 1998 applications. Planning in ignoring our exposure of the HAF chicanery in our written protest for and appearance at the 18 January 2001 Planning hearing are/were no longer naïve to the situation. Planning bought liability (as would the Supervisors if they ignore Vera's pleas herein), for complicity in the irreparable destruction of the public's Lynn Vietor Nature Preserve by its fiducially irresponsible trustees HAF of the public land, if a building permit is issued, and construction (destruction) goes ahead.

In thumbnail, our aunt Vera Perrott Vietor created the Lynn Vietor Nature Preserve in her 1972 will (see exhibit in our 4 Jan 01 correspondence to Planning and attached hereto), with a San Francisco Trust Bank (then Crocker, now Well Fargo) as trustee. HAF became `successor' trustee of the Indianola property (Nature Preserve) in a dubious court action in 1994, without Vera's `interested and affected' heirs being advised, thus being represented in court. HAF not understanding or purposefully ignoring their fiduciary responsibility to protect the Nature Preserve, did just the opposite, destroyed it, with a permit from Planning (applied in 1994), construction (destruction) in 1995. From Vera's standpoint, she created a `grant giving' Santa Clause HAF in 1972, as it was up to 1994. In 1994, Vera's Santa Claus morphed (becoming trustees of the property) into a Frankenstein monster version of HAF that has breached Vera's will, and is destroying the heartfelt gifts Vera's mandated be guarded `native and unspoiled' (not even a picnic table), for the public and posterity. HAF as Santa Claus should simply move offsite to expand. The Nature Preserve and architecturally significant Vietor residence cannot be moved. HAF can play Santa Claus and make grants from anywhere in Humboldt County.

Fiducially irresponsible HAF was at it again in 1998, applying to destroy about 10% of the public's Lynn Vietor Nature Preserve with a 4000 SF building and 65 slot asphalt parking lot. See HAF Pennekamp's 10 June 1999 press release (in our 4 Jan 01 correspondence to Planning). HAF has egregiously intimated in court that they have to destroy the Nature Preserve (and residence) to carry out their philanthropic mission. Not so. HAF could have, should have simply moved offsite. But then HAF could no longer invade Vera' principal for the $1.3 million building cost (contracted construction cost only), as they could no longer egregiously claim it was for `maintenance' of the property they usurped the trusteeship of (1994). This is the same mantra HAF used to invaded outlawed Trust principal for the 1995 north of the residence, landscaping and residence `destruction'.

I take the liberty to include two new exhibits. One, the tax assessors description of the property, showing HAF not as `owners' but trustees, and a page off HAF's internet site where HAF mention the Lynn Vietor Nature Preserve (as their lawyers have egregiously argued that it does not even exist). We plead with you all as Supervisors to stop the destruction of the public's Lynn Vietor Nature Preserve by not issuing a building (destruction) permit to HAF. The Planning provided four page `filing form' and $1373 filing fee was enclosed in the earlier correspondence. Thanks

North Coast public. Call or write your supervisor to object to HAF destroying YOUR LYNN VIETOR NATURE PRESERVE and historic John Yeon designed Vietor residence. This matter is currently scheduled for public hearing at the end of March.

If Vera's appeal is turned down by the Humboldt County Board of Supervisors, Vera's watchdogs will appeal to the California Coastal Commission, as the preserve is only about one quarter mile from the Humboldt Bay Shore, and the Coastal Commission has 'after-county-appeal' authority to rule or over rule..
